1. Suitability
Customer must be 18 years or older to use
a service of Green Apple.
2. Non-Transferability
Use of a service of Green Apple is not
transferable from Customer to another party without prior notification to
Green Apple of the extent and purpose of the transference.
3. Lawfulness
The services provided by Green Apple may
only be used for lawful purposes.
The transmission of
any material in violation of any US, state or local regulation is prohibited.
This includes, but is not limited to, copyrighted material, material legally
judged to be threatening or obscene, or material protected by trade secret.
4. Conduct
Customer agrees not to impinge in any
manner upon the use and enjoyment of the Internet by others; not to transmit
any threatening, harassing, profane, libelous, obscene or pornographic
material or objectionable material of any kind; not to engage in activity
relating to their Internet usage which is threatening, harassing, profane,
defamatory, obscene or pornographic.
Customer agrees not to engage in any
activity which may cause harm to any of the material or software components
that make up the Internet; which attempts to compromise or thwart the security
of any account, host or network on the Internet; which interferes with
activities of any user, group, host or network on the Internet, including, but
not limited to, such activities as the transmission of material harmful to
other systems such as a virus, cancelbot, trojan horse or worm; attempting to
circumvent authentication or security of any Internet account, host or
network; forging email or Usenet header information; sending large numbers of
unsolicited mail messages; forwarding or posting "chain letters"; repeated
posting of inappropriate messages to a Usenet newsgroup; posting of an
inappropriate message to a large number of Usenet newsgroups; attempting to
masquerade, cancel, or otherwise interfere with email or Usenet posts other
than one's own; engaging in harassment, whether through language, volume or
size of postings in email or Usenet newsgroups; engaging in an activity which
aims to reduce the effectiveness or usability of an Internet service;
circumventing the rules of a service or system by acquiring multiple accounts
to hide presence of activity.
Customer agrees to comply with the rules
of those services and systems which they utilize through a service of Green
Apple.
5. Privacy
Green Apple does not
rent, sell or give away personal information, such as name, email address,
billing data, or service activity, relating to Customer's use of its service
and does its best to protect such information. Personal information is
released only when authorized by Customer, when necessary to comply with the
law, or when required for system administrative purposes.
Green Apple
reserves the right to periodically send email to Customer regarding offers,
service use and availability, billing issues, technical matters and other
information relating to their Internet service with us.
6. Billing
Customer agrees to pay Green Apple for the
charges incurred by them for using a Green Apple service. Payment is due upon
receipt of invoice. Customer is in default if payment is not received within
twenty-one days after date of invoice. Returned checks subject Customer to a
$20.00 fee from Green Apple and Customer goes into default.
A Customer in default may have their
service interrupted and is subject to an interest charge of 1.5% per month on
their outstanding balance. Customer agrees to pay Green Apple reasonable
expenses, including attorney and collection agency fees, which might be
incurred in the collection of Customer's outstanding balance. To avoid default
or service interruption, a Customer should contact Green Apple to make payment
arrangements.
A Customer having a service billed on a
periodic basis will have their first invoice pro-rated within the term of
their billing cycle. Upon cancellation of service, Customer will be invoiced
an amount pro-rated to the date of cancellation.
7. Cancellation
Service may be canceled in writing or by
telephone. Only a notification to cancel service frees Customer of the
obligations of their service.
8. Failure to Comply
Green Apple may deny Customer access to
all or part of their service without notice if it finds Customer is in
violation of any of the terms of this policy statement. A Customer denied
access to service has no right to any material stored on Green Apple's system
and no right to access third party services, merchandise or information
through a Green Apple provided service.
9. Disclaimers
The services of Green
Apple are provided "AS IS, AS AVAILABLE" without any warranty of any kind.
Green Apple disclaims any warranty of merchantability or fitness for a
particular purpose. Green Apple disclaims responsibility for the accuracy and
quality of information which Customer obtains using Green Apple services.
Green Apple disclaims responsibility for any service or merchandise which
Customer obtains using Green Apple services. Green Apple makes no warranty
against the divulgement of Customer personal information, although it is Green
Apple's practice to do its best to protect against such divulgement. Green
Apple disclaims responsibility for any damage Customer suffers from the use of
its services and Customer agrees to indemnify and hold harmless Green Apple
from any claims resulting from their use of its services, including damages
relating to the loss of data, data delays, data misdeliveries or service
interruptions. Use of Green Apple services is at Customer's own risk.

11. Acceptance
Use of service constitutes an acceptance
of the terms of this policy statement by Customer.
The terms of this
policy statement supersede all the terms of any preceding policy statement.
These terms may be modified by Green Apple upon 30 days prior notification.
Notification of changes to the terms of this policy statement will be made in
a public forum accessible to all Customers of Green Apple. Continuation
of service by Customer following a modification of terms constitute an
acceptance of the modified terms.
This policy statement shall be governed by
and construed in accordance with the laws of the State of Ohio.
Any cause of action
Customer may have with respect to a service of Green Apple must be commenced
within one (1) year after the claim or cause of action arises or such claim or
cause of action is barred.
