| Green Apple News: Federal Antispam Bill Signed | |||||
| December 17, 2003
President Bush recently signed the first
federal antispam bill to go into effect January 1, 2004. The bill takes
precedence over established state laws regarding spam such as
Ohio's
Revised Code Section 2307.63. Named the "Can Spam Act", the law
places penalties on falsifying email header information associated with spam
email. Those that "spam" may face up to 1 year in prison along with
fines. In addition, this bill gives legitimacy for marketers to send
unsolicited email as long as the emails have a truthful email header
information, including a legitimate return email address, sender, and an
opt-out option within the email. Marketers must do so following new federal
guidelines or else face prosecution. The Federal Trade Comission will be
responsible for enforcing the new spam law. Critics say the law will not
reduce spam but will only make unsolicited emails "truthful". Others
claim this law is a step in the right direction towards reducing spam on a
national level. For more information on fighting spam, please see |
